Preamble
This Cookie Policy is issued by Black Swan Ventures Group LLC (the "Company") and describes the cookies and analogous technologies deployed upon the website located at cashflowpositive.ai. It supplements, and is to be read as one instrument with, the Privacy Policy, the Do Not Sell or Share My Personal Information notice, and the Sub-processor Register.
1. Interpretation
1.1 "Cookie" means a small text file placed upon the user's device by the browser, and for the purposes of this Policy includes local storage, session storage, pixels, tags, beacons, and software development kits, being technologies of like effect.
1.2 "Strictly necessary" bears the meaning attributed to it by Article 5(3) of Directive 2002/58/EC and by § 25(2) of the Telekommunikation-Digitale-Dienste-Datenschutz-Gesetz, namely a technology the sole purpose of which is to carry out the transmission of a communication, or which is strictly necessary in order to provide a service expressly requested by the user.
2. Consent
2.1 By operation of Article 5(3) of Directive 2002/58/EC, as implemented in Germany by § 25 of the Telekommunikation-Digitale-Dienste-Datenschutz-Gesetz, no Cookie other than one which is strictly necessary shall be placed upon the user's device prior to the giving of consent.
2.2 The Company's consent management interface accordingly:
- is displayed upon first access, and in advance of the execution of any non-essential script;
- affords the options Accept all, Reject all, and Manage preferences, each of equal prominence and of equal ease of operation;
- employs no pre-selected option in respect of any non-essential category;
- records the user's election together with the time thereof, so as to constitute evidence of consent for the purposes of Article 7(1) GDPR;
- renews the enquiry upon the expiry of twelve months, or sooner in the event of material alteration to the technologies deployed; and
- may be reopened at any time by means of the Cookie Preferences control appearing in the footer of every page.
2.3 Consent may equally be withheld or withdrawn by configuration of the browser. The user is put on notice that the suppression of strictly necessary Cookies may impair the functioning of the website.

Where the Company deploys a cookieless analytics facility hosted within the Union, that fact shall be stated at this clause, and no consent shall be required in respect of it.

Where no technology of this description is deployed, this clause shall be deleted and a statement to that effect substituted, the consequence being a materially reduced compliance burden under the privacy statutes of the United States.

4. Third-Party Processing
Where a technology is placed by a third party, that party processes the resulting data pursuant to its own privacy notice and may, in respect of such processing, act as an independent controller. The identities of such parties are maintained in the Sub-processor Register.
5. Transfers to Third Countries
Certain providers process data within the United States or other third countries. Such transfers are effected upon the safeguards described at clause 6 of the Privacy Policy.
6. Review
This Policy is reviewed upon every addition to or removal from the technologies deployed, and in any event not less frequently than annually.
