These Terms of Service ("Terms") govern your access to and use of the cashflowpositive.one website, publications, workshops, retainers, and any related services (together, the "Services") provided by Black Swan Ventures Group LLC ("Company", "we", "us"). By accessing the Services you agree to be bound by these Terms.
1. The Services
Cash Flow Positive publishes The Report, operates a "Free Fix" selection program, and offers paid workshops and retainer engagements. Applications to the Free Fix program are reviewed by our team; selection is at our sole discretion and is not guaranteed.
2. Eligibility
You must be at least 18 years old and legally able to enter into binding contracts to use the Services. If you apply on behalf of a company, you represent that you are authorized to bind that company to these Terms.
3. Applications & Selection
Applications must be truthful and complete. We may verify the information you submit. We reserve the right to decline any application without explanation. Selected participants agree to reasonable cooperation during implementation and to be featured in written case studies (with the right to review before publication).
4. Paid Services
Fees for workshops, retainers, and other paid Services are stated at the point of purchase. Unless expressly stated otherwise, fees are quoted in U.S. dollars, are exclusive of applicable taxes, and are non-refundable once work has commenced. Refund and cancellation terms specific to a program are described in the applicable order form.
5. Intellectual Property
All content on the site — including The Report, articles, illustrations, code snippets, frameworks, and brand assets — is owned by or licensed to Black Swan Ventures Group LLC and is protected by intellectual property laws. You may not reproduce, redistribute, or create derivative works without our prior written permission, except for personal, non-commercial use of publicly published materials with proper attribution.
6. User Content
By submitting content to us (including application data, testimonials, and materials shared during engagements), you grant Black Swan Ventures Group LLC a worldwide, royalty-free license to use that content solely for the purposes of delivering the Services and creating case-study material as agreed in writing.
7. Confidentiality
Non-public information you share with us during an engagement is treated as confidential and used only to deliver the Services. Additional confidentiality terms may be captured in a separate written agreement.
8. Disclaimers & No Guarantees
The Services are provided "as is". We make no guarantee of specific financial, revenue, or operational outcomes. Case studies and quoted results reflect the experience of individual clients and are not commitments to future performance.
9. Limitation of Liability
To the maximum extent permitted by law, Black Swan Ventures Group LLC, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Services. Our total aggregate liability for direct damages shall not exceed the greater of (a) the fees paid by you in the twelve months preceding the claim or (b) USD 500.
10. Indemnification
You agree to indemnify and hold harmless Black Swan Ventures Group LLC from claims arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.
11. Termination
We may suspend or terminate access to the Services at any time, with or without notice, for conduct that we reasonably believe violates these Terms or is otherwise harmful.
12. Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws principles. Exclusive jurisdiction and venue for any dispute lie with the state and federal courts located in Sheridan County, Wyoming, unless mandatory consumer protection laws in your country of residence require otherwise.
13. Changes
We may update these Terms from time to time. Material changes will be indicated by updating the "Last updated" date on this page. Continued use of the Services after changes constitutes acceptance.
